Return & Refund Policy


1. Introduction

AlanUmbro Società Semplice Agricola (brand: VerdePaciano) ("we", "our", or "us") operates verdepaciano.com (the "Service").

This Return & Refund Policy explains your rights regarding returns, refunds, and the right of withdrawal when purchasing products from our online store. This policy is provided in accordance with the EU Consumer Rights Directive (Directive 2011/83/EU) and Italian consumer protection law (Codice del Consumo, D.Lgs. 206/2005).

Please read this policy carefully before making a purchase. If you have any questions, please contact us before completing your order.


2. Right of Withdrawal

2.1 Your Right

As a consumer purchasing from our online store, you have the right to withdraw from the purchase contract within 14 calendar days without giving any reason, in accordance with Articles 52–59 of the Italian Codice del Consumo (D.Lgs. 206/2005) and Articles 9–16 of the EU Consumer Rights Directive (2011/83/EU).

The withdrawal period expires 14 calendar days from the day on which you, or a third party designated by you (other than the carrier), physically receives the goods.

For orders consisting of multiple items delivered separately, the withdrawal period expires 14 days from the day you receive the last item.

2.2 How to Exercise Your Right of Withdrawal

To exercise your right of withdrawal, you must inform us of your decision by a clear statement. You may use any of the following methods:

You may use the Model Withdrawal Form provided in Section 6 of this policy, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient that you send your communication before the 14-day withdrawal period has expired.

2.3 Effects of Withdrawal

If you withdraw from the contract, we will reimburse all payments received from you, including the cost of standard delivery (except for supplementary costs arising if you chose a type of delivery other than the least expensive standard delivery offered by us).

We will make the reimbursement without undue delay, and in any event no later than 14 days from the day on which we are informed of your decision to withdraw from the contract.

We may withhold the reimbursement until we have received the goods back or until you have supplied evidence of having sent the goods back, whichever is earliest.

We will carry out the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of the reimbursement.


3. Return Conditions

3.1 Condition of Returned Goods

You are liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Returned products must be:

  • In their original, unopened packaging (seal intact)
  • Unused and in the same condition as when received
  • Accompanied by all original labels, tags, and accessories

3.2 Returning the Goods

You must send back the goods without undue delay and in any event no later than 14 days from the day on which you communicate your withdrawal to us.

The deadline is met if you send back the goods before the period of 14 days has expired.

3.3 Return Shipping Costs

You shall bear the direct cost of returning the goods, unless we have agreed to bear them or we failed to inform you that you must bear the costs.


4. Exceptions to the Right of Withdrawal

In accordance with Article 59 of the Italian Codice del Consumo (D.Lgs. 206/2005), the right of withdrawal does not apply to the following:

  • Goods which are liable to deteriorate or expire rapidly (Article 59, letter d)) — as a perishable food product, olive oil that has been opened is subject to deterioration through oxidation and is not suitable for return
  • Sealed goods which are not suitable for return due to health protection or hygiene reasons, and which were unsealed after delivery (Article 59, letter e)) — this includes olive oil bottles whose safety seal has been broken or opened after delivery
  • Goods which, after delivery, are inseparably mixed with other items
  • Goods made to the consumer's specifications or clearly personalized (e.g., custom gift sets)

4.1 What You CAN Return

  • Sealed, unopened bottles with the original safety seal intact may be returned within the 14-day withdrawal period described in Section 2
  • Bottles must be in their original packaging and in the same condition as when delivered

4.2 What You CANNOT Return

The following are not eligible for return or refund:

  • Olive oil bottles that have been opened (safety seal broken), for hygiene and food safety reasons per Article 59, letters d) and e) of D.Lgs. 206/2005
  • Products close to or past their expiration date at the time of return
  • Products that have been improperly stored (exposed to heat, direct sunlight, or moisture) after delivery
  • Products damaged by the customer after delivery
  • Gift sets or products that have been personalized to your specifications

5. Damaged or Defective Products

5.1 Damaged During Shipping

If your order arrives damaged during shipping, please:

  1. Document the damage with photographs (both outer packaging and product)
  2. Contact us within 48 hours of delivery at info@verdepaciano.com
  3. Include your order number, a description of the damage, and photos

Depending on the extent of the damage, we will offer one of the following remedies:

  • Full replacement of damaged items at no charge, including return shipping
  • Full refund for items that cannot be replaced (e.g., limited-edition products out of stock)
  • Partial reimbursement proportional to the damage if only some items in the order are affected or if the product is still usable despite cosmetic packaging damage

We may ask you to return the damaged items at our expense before processing the replacement or refund. Failure to report damage within 48 hours may affect our ability to process your claim with the shipping carrier.

5.2 Defective Products

If you receive a defective product, you are entitled to remedies under the Legal Guarantee of Conformity (Articles 128–135 of the Codice del Consumo, D.Lgs. 206/2005). This guarantee covers defects that become apparent within 2 years of delivery.

You must notify us of the defect within 2 months of discovering it.

Under the legal guarantee, you have the right to:

  1. Repair or replacement of the defective product (free of charge)
  2. Price reduction or contract termination if repair/replacement is not possible or excessively burdensome

7. Refund Process

7.1 Refund Timeline

Once we receive and inspect the returned goods, we will notify you via email about the status of your refund.

  • Approved refunds will be processed within 14 days of receiving the returned goods
  • Refunds are issued to the original payment method
  • Depending on your bank or payment provider, it may take an additional 5–10 business days for the refund to appear in your account

7.2 Late or Missing Refunds

If you have not received your refund within the expected timeframe:

  1. Check your bank account or credit card statement again
  2. Contact your bank or payment provider, as there is often a processing delay
  3. If you still have not received your refund, contact us at info@verdepaciano.com

8. Applicable Law and Jurisdiction

8.1. This Return & Refund Policy is governed by the laws of the Italian Republic, including the Codice del Consumo (D.Lgs. 206/2005).

8.2. For consumers residing in Italy, the competent court is that of the consumer's place of residence or domicile, pursuant to Article 66-bis of the Consumer Code. For consumers residing elsewhere in the EU, jurisdiction follows EU Regulation 1215/2012.

8.3. For any dispute not subject to mandatory consumer jurisdiction rules, the competent court shall be the Court of Perugia (Tribunale di Perugia), Italy.
